CITY ORDINANCE NO. 519

AN ORDINANCE CREATING THE OFFICE OF PERSONS WITH DISABILITY AFFAIRS (OPDA) AND PROVIDING FUNDS THEREOF
WHEREAS, Section 16 of general welfare clause of RA 7160 provides in part that every local government unit shall exercise powers necessary for its efficient and effective governance and those which are essentials to the promotion of general welfare;
WHEREAS, The World Program of Action concerning disabled persons was adopted by the UN in 1982 through resolution 317/52;
WHEREAS, Pursuant to the said resolution it calls for local authorities and other bodies within the public and private sectors to implement national measures contained in the world program of action;
WHEREAS, Batas Pambansa Blg. 344, otherwise known as the Accessibility Law, mandates all local government to promote a barrier free physical environment for the disabled persons;
WHEREAS, Section 2 of the Republic Act 7277, also known as the Magna Carta for the Disabled Persons states the rehabilitation of the disabled person shall be concerns of government on order to foster their capacity to attain a more meaningful, productive and satisfying life;
WHEREAS, Proclamation 240, or the proclamation of the year 2003-20013 as the Philippine Decade of Disabled Persons, directs all local government units at the national and local levels to develop and implement programs and activities that will encourage active participation of persons with disability in social and economic activities in their communities; Whereas, the local government code 1991 states that local government units shall endeavor to be self-reliant and shall discharge the functions and responsibilities of national agencies and offices devolved to them;
NOW THEREFORE, be it ordained by Sangguniang Panglungsod of the City of Bacolod in session assembled, that:
ARTICLE 1. TITLE this proposed ordinance shall be AN ORDINANCE CREATING THE OFFICE OF PERSON WITH DISABILITY AFFAIRS AND PROVIDING FUNDS THEREOF.
ARTICLE2. The office of persons with disability affairs (OPDA) functions. There shall be created and office of persons with disability affairs that will coordinate all activities and implement plans, programs including but not limited to providing assistance to the problems, concerns and issues of PWDs gathering of data of PWDs including the directory of NGOs, POs and the like and projects formulated and approved by the city council for the welfare of disabled persons (CCWDP). It shall also take charge of all the administrative concerns and requirements of the office and the city council for the welfare of disabled persons (CCWDP).
2.1 COMPOSITION. The office of persons with disability affairs shall be composed or staffed with PWD affairs officer, regular or permanent position, who shall head the office and two other personnel pool of qualified PWD employees of the city or any qualified persons with disability.
ARTICLE 3. FUNDS. The office of persons with disability affairs shall be annually appropriated an amount not less than two hundred fifty thousand pesos (PHP 250,000.00) for its administrative and operational requirements on the basis of the approved work and financial plans of DSSD in favor of city council for the welfare of disabled persons.
ARTICLE4. TRANSITORY PROVISIONS.
4.1 Pending the creation of office and its attendant staffing as subject to the budget ceiling limitations by the civil service commissions and department of budget and management, the city mayor is hereby authorized to transfer and or detail any personnel with the relevant work experience to temporary staff the office in transition.
ARTICLE5. SEPARABILITY CLAUSE. If for any reasons, any part or provisions of this codes shall be held unconstitutional or invalid other parts or provisions hereof which are not affected thereby shall continue to be in full force and effect. Furthermore, this ordinance modifies and/or supplements other relevant and existing city ordinance(s).
ARTICLE6. REPEALING CLAUSE. Pursuant to executive order 709, dated February 26, 2008 duly signed by the executive secretary for the president, i.e. redefining the functions and organizational structure of national council for the disability affairs the name city council for the welfare of disabled persons (CCWDP) as mentioned above and executive orders issued by the city mayor constituting or recreating the CCWDP is hereby corrected or amended to read as Bacolod City Council on Disability Affairs (BCCDA).
ARTICLE7. EFFECTIVITY. This ordinance effect immediately upon approval thereof in accordance with law.
