NCDA BOARD RESOLUTION N0. 6 SERIES OF 2020
A RESOLUTION ON THE DEVELOPMENT OF A THREE-YEAR PLAN FOR THE SUB-COMMITTEE ON EDUCATION
WHEREAS, NCWDP Board Resolution No. 14, Series of 2004 adopts the creation of the Sub-Committee on Education of then National Council for the Welfare of Disabled Persons (NCWDP), now the National Council on Disability Affairs (NCDA);
WHEREAS, the said Sub-Committee under its current Charter is tasked to undertake the following functions:
(1) Recommend policies to the NCDA Governing Board and other government policymaking entities that would facilitate adoption of policies that adhere to the right to education of persons with disabilities;
(2) Conduct researches and studies on the furtherance of policy development covering education of students with disabilities;
(3) Establish a network with multi-stakeholders on education for the purpose of (a) consultation, (b) implementation of policies, (c) program development, (d) monitoring and evaluation, and (e) advocacy relating to education of students with disabilities; and
(4) Conduct periodic meetings and such other meetings as the need arise.
WHEREAS, the Salamanca Statement and Framework for Action on Special Needs Education stipulates, among others, “… the necessity and urgency of providing education for children, youth and adults with special educational needs within the regular education system”;
WHEREAS, Article 24 of the United Nations Convention on the Rights of Persons with Disabilities (UNCRPD) requires “States Parties to recognize the right of persons with disabilities to education” and whereof are not excluded from the general education system;
WHEREAS, the Dakar Framework on Education for All recognizes that “every child, youth and adult has the right to meet their basic learning needs, including learning to know, to do, to live together and to be”;
WHEREAS, Article 14, Section 1 of the 1987 Philippine Constitution, provides that “The State shall protect and promote the right of all citizens to quality education at all levels and shall take appropriate steps to make such education accessible to all”;
WHEREAS, Chapter 2, Section 12 of Republic Act No. 7277 otherwise known as the “Magna Carta for Persons with Disability”, as amended, states, among others, that “the State shall ensure and take appropriate steps to provide persons with disabilities adequate access to quality education and ample opportunities to develop their skills”;
WHEREAS, Republic Act No. 7722 better known as the “Higher Education Act of 1994” provides, among others, for CHED “to ensure that higher quality education is accessible to all who seek it particularly those who may not be able to afford it”;
WHEREAS, Republic Act No. 7796 otherwise known as “TESDA Act of 1994” aims “to encourage the full participation of and mobilize the industry, labor, local government units, and technical-vocational institutions in the skills development of the country’s human resources”; and
WHEREAS, Republic Act No. 10533 better known as “Enhanced Basic Education Act of 2013” stipulates under Section 2 that “the State shall establish, maintain and support a complete, adequate and integrated system of education relevant to the needs of the people, the country and society-at-large.” Furthermore, Section 3 (Basic Education) thereof encompasses kindergarten, elementary and secondary education as well as alternative learning systems for out-of-school learners and those with special needs “to meet basic learning needs which provides the foundation on which subsequent learning can be based.”
NOW, THEREFORE, RESOLVED as it is hereby resolved, to develop a three-year plan for the Sub-Committee on Education in accordance with the existing programs of the government that are being implemented by its education-lead agencies.
RESOLVED FINALLY that a 3-year plan for each concerned agency be prepared as follows:
(a) Basic Education – Department of Education;
(b) Higher Education – Commission on Higher Education; and
(c) Technical-Vocational Education – Technical Education and Skills Development Authority.
