A RESOLUTION DELEGATING APPROVAL OF SUCCEEDING COUNCIL RESOLUTIONS AND/OR ITS EQUIVALENT TO THE NATIONAL COUNCIL ON DISABILITY AFFAIRS CHAIRPERSON AND DESIGNATED OFFICIALS
WHEREAS, Republic Act No. 7277 as amended, otherwise known as the “Magna Carta for Persons with Disability,” establishes policies and mandates for the rehabilitation, self-development, and integration of disabled persons into the mainstream of society.
WHEREAS, Executive Order No. 709, s. 2008, reorganized the National Council on Disability Affairs (NCDA) and provided for its functions, structure, and composition.
WHEREAS, Republic Act No. 8425, otherwise known as the “Social Reform and Poverty Alleviation Act,” aims to address the needs of marginalized sectors, including persons with disabilities.
WHEREAS, Republic Act No. 6713, otherwise known as the “Code of Conduct and Ethical Standards for Public Officials and Employees,” sets the standards of professionalism, integrity, and accountability in public service.
WHEREAS, the Council recognizes the importance of expediting the approval process of resolutions and/or its equivalent, to enhance efficiency and effectiveness in addressing disability-related issues and concerns;
WHEREAS, streamlining the approval process by designating specific officials will facilitate timely decision-making and implementation of resolutions and/or their equivalent;
WHEREAS, the NCDA Board Members recognize the importance of aligning with the guidelines and procedures in the adoption of resolutions pertaining to disability concerns.
The Board Members acknowledge the necessity of providing a mechanism for members to review and submit recommendations or comments on resolutions proposed for adoption by the NCDA. It is hereby agreed by the Board Members that:
1. Any proposed resolution for ad referendum approval of the NCDA Board shall be deemed approved by the Board Members if no recommendation or comments are received by its Secretariat within the date specified therefor;
2. The specified timeframe for submission of recommendations or comments on those resolutions shall be properly communicated to all members;
3. Members shall be given sufficient time to review and provide feedback on resolutions;
4. If no such recommendation or comment is referred within the specified timeframe, the resolution under consideration shall be deemed adopted by the Board Members and the fact of such adoption shall be formalized by the signing of the resolution by the NCDA Chairperson, for and/or behalf of all the other Board Members, and duly attested by the NCDA Secretariat/Executive Director; and
5. Copies of the resolution so adopted and signed shall be distributed by the NCDA Secretariat to all the Board Members for their information.
WHEREAS, Chairperson and concurrent Department of Social Welfare and Development (DSWD) Secretary, possesses the requisite expertise and authority to evaluate and approve disability-related resolutions;
WHEREAS, delegating authority to the NCDA Chairperson and the Executive Director of the NCDA will ensure accountability and transparency in the approval process;
RESOLVED THEREFORE AS IT IS HEREBY RESOLVED, that all succeeding resolutions for ad referendum approval of the NCDA Board shall be processed in accordance with the foregoing guidelines. Resolutions shall no longer be routed to each board member for approval and endorsement but shall be delegated to the NCDA Chairperson, the DSWD Secretary, and to the head of NCDA Secretariat, the Executive Director of the NCDA.
Let copies of this Resolution be furnished to NCDA and Member Agencies for information and appropriate action.
This resolution shall take effect immediately upon approval.
